DANIEL EISENBERG, Esq.
Daniel’s practice centers around intellectual property, in the areas of patent and trademark registration prosecution. He prepares legal opinions and counsels clients regarding patentability, trademark availability, patent or trademark infringement, freedom to operate, and right to use.
In the areas of intellectual property protection and disputes, Daniel has represented numerous clients in patent infringement, copyright infringement, trade dress infringement, contract disputes, and trade secret cases. He has successfully negotiated large settlements in litigation and pre-litigation matters.
Focus
Daniel’s focus is securing patents in the areas of Software, Artificial intelligence, Mobile applications, Augmented/virtual reality, Consumer products, Gaming systems, Medical devices, Malware detection, Mechanical devices, Smart tools, Blockchain applications, Manufacturing and business methods and systems, and Industrial designs.
Daniel has experience in both U.S. and International filings under the Patent Cooperation Treaty (PCT). He has also argued before the Patent Trial and Appeals Board (PTAB). Daniel also prepares non-disclosure, intellectual property assignment agreements, and licensing agreements.
Background & Education
Dan received his J.D. from Syracuse University School of Law, where he served in the Student Senate and placed third in a national legal writing competition. Dan received his B.B.A. from Mercer University in Finance and an A.A.S. in Computer Science from Union County College. He is licensed to practice in New York State, the District of Columbia, and the Federal Patent Bar.
